1. Introduction
These Terms & Conditions (“Terms”) govern your access and use of the eatat application
(“App”), website, and related services (together, the “Services”) provided by Kolmvision OÜ,
registered in Estonia under company number [insert number], with registered office at [insert
address] (“Company,” “we,” “us,” or “our”).
By accessing or using our Services, you agree to be legally bound by these Terms. If you do not
agree, you must not use the Services.
2. Definitions
- “User” – an individual using the Services to make reservations.
- “Provider” – restaurants, cafes, or dining establishments offering services via the App.
- “Booking” – a confirmed reservation made through the Services.
- “Content” – text, graphics, logos, images, software, and other materials provided on the
Services.
3. Eligibility
- You must be at least 18 years old to use the Services.
- By registering, you represent that the information you provide is accurate and up-to-date.
4. Our Role
- eatat provides a technology platform to facilitate bookings between Users and Providers.
- eatat does not own, operate, or control any Provider and is not a party to any contract
between Users and Providers. - Providers remain responsible for:
- Food quality, preparation, and safety;
- Compliance with health, hygiene, and licensing laws;
- Fulfilling confirmed bookings in good faith.
4A. What We Do / Don’t Do
We Do:
- Provide a booking platform for Users and Providers.
- Offer personalized recommendations and booking management.
- Facilitate secure communication and payments.
We Don’t:
- Cook or serve food.
- Guarantee restaurant availability or service quality.
- Assume responsibility for food safety, allergies, or experiences at Providers.
5. Account Registration
- Users and Providers must register an account to access Services.
- You are responsible for keeping login credentials secure.
- We may suspend or terminate accounts for fraud, misuse, or breach of these Terms.
6. Bookings, Payments & Cancellations
- Bookings are subject to Provider confirmation.
- All payments are processed securely by Stripe. eatat does not hold or control customer funds.
- The Provider (restaurant) is the merchant of record for all transactions.
- Cancellation/refund policies, chargebacks, and disputes are the sole responsibility of the
- Provider.
7. Provider Responsibilities
Providers must:
- Hold valid business and health licenses.
- Maintain required Public Liability Insurance.
- Provide accurate menus, pricing, and availability.
- Fulfill confirmed bookings.
The Provider assumes full responsibility for all transactions, food, and services provided to Users. The Provider agrees to indemnify and hold harmless eatat (Kolmvision OÜ), its affiliates, and owners from any claims, chargebacks, or disputes arising between the Provider and Users.
8. Intellectual Property & Brand Use
- All trademarks, logos, and brand elements of eatat and Kolmvision OÜ are protected by
law. - You may not use, copy, or reproduce eatat’s branding without written consent.
- Unauthorized use may result in legal action.
9. User Content & License
- Users and Providers may submit content (reviews, menus, photos, etc.).
- By submitting content, you grant eatat a worldwide, royalty-free license to use, display,
and distribute it in connection with the Services. - You are responsible for content you upload and must not infringe third-party rights.
10. Acceptable Use Policy
You agree not to:
- Use the Services for unlawful or fraudulent purposes.
- Misrepresent your identity or affiliation.
- Upload malware, viruses, or harmful code.
- Copy, scrape, or attempt to reverse-engineer our Services.
- Abuse, harass, or spam other Users or Providers.
11. Third-Party Content & Links
- The Services may include links or references to third-party websites.
- We are not responsible for third-party content, accuracy, or practices.
- Your interactions with third parties are at your own risk.
12. Dispute Resolution
- User–Provider disputes must be resolved directly between the parties.
- eatat may facilitate communication but is not obligated to mediate.
- eatat disputes will be resolved via binding arbitration in Tallinn, Estonia, under Estonian
law.
13. Liability & Disclaimers
- The Services are provided “as is” and “as available,” without warranties.
• We disclaim liability for:- Food safety, allergies, or dietary restrictions.
- Service quality or accuracy of Provider listings.
- Booking errors, cancellations, or no-shows.
eatat is not a bank, money transmitter, or financial services provider. All payment services are provided
by Stripe under their terms of service. By using the platform, you acknowledge that eatat’s role is limited
to facilitating reservations and payment processing through Stripe.
- Limitation of Liability: To the maximum extent allowed by law, eatat’s liability is
capped at:- €100, or
- The total fees paid to eatat in the last 12 months (whichever is higher).
14. Updates & Beta Features
- Some features may be released as beta or test functions.
- These are provided “as is” without warranty.
- We may modify or discontinue them at any time.
15. Termination of Service
- We may suspend or terminate accounts at our discretion if you:
- Breach these Terms;
- Misuse the Services;
- Engage in illegal activity;
- Remain inactive for over 12 months.
16. Insurance
- Providers are required to carry insurance required in their jurisdiction.
- eatat may maintain corporate liability insurance but does not cover User–Provider
transactions.
17. Indemnification
You agree to indemnify and hold harmless Kolmvision OÜ, its officers, employees, and affiliates
against claims, damages, or losses arising from:
- Your use of the Services;
- Your breach of these Terms;
- Your violation of third-party rights.
18. Privacy & Data Protection
- Use of Services is subject to our Privacy Policy.
- By using eatat, you consent to our data collection and processing practices.

19. Governing Law
These Terms are governed by the laws of Estonia and the EU. Disputes are subject to Estonian

20. Miscellaneous
- Severability: If one clause is invalid, the rest remain enforceable.
- Entire Agreement: These Terms represent the full agreement between you and us.
- Force Majeure: We are not responsible for delays caused by events outside our control.
- Assignment: You may not assign these Terms without consent. We may assign them in
connection with a merger, acquisition, or restructuring.
